Code on Wages Bill

Code on Wages, 2019 (India)


The code on wages bill was introduced in Loksabha on 23 July 2019 by the minister of labour, Mr. Santosh Gangwar.

It is for regulating wages and Bonus in all employments.

The code replaces following Laws:

1. The Payment of Wages Act, 1936
2. The Minimum Wages Act, 1948
3. The Payment of Bonus Act, 1965
4. The Equal Remuneration Act, 1976

The Code will apply to all employees & industries (except Defense)

Central government will take wage related decisions for Railways, Mines & oil fields.

Sate Government shall make decisions related to Industries which are not governed by Central Government.

The Central Government shall decide floor wages. If state government has minimum wages above floor wages then it can not reduce it to floor wages. State government can decide on minimum wages but minimum wages shall not be less than floor wages.

Wages shall be paid in current coins, currency notes, by crediting in bank account or through electronic mode.

Wage period shall be fixed by employer either : Daily / Weekly/  Fortnightly / Monthly

Wages may be deducted on Absence from duty/ accommodation expenses born by employer / recovery of advances given to the employee. The deductions shall not exceed 50% of the total wages.

Bonus: Min: 8.33% of wages and max: 20% of wages or ₹100.00 whichever is higher.

There shall be no gender discrimination in recruitment or wages for work of similar nature.
